excerpted from the meeting minutes of the Jefferson County Commission held
September 5, 2007:
PETITIONS/ORDERS
Order 09-05-2007F of the
County Commission of the
County of Jefferson,
Missouri rejecting and denying the
Petition for the
incorporation of the city to be known as
“the City of High Ridge,
Missouri”
Commissioner Kemp introduced and made the motion for the
enactment of the following Order:
ORDER 09-05-2007F OF THE
COUNTY COMMISSION OF THE COUNTY OF JEFFERSON, MISSOURI REJECTING AND DENYING THE
PETITION FOR THE INCORPORATION OF THE CITY TO BE KNOWN AS “THE CITY OF HIGH
RIDGE, MISSOURI”
WHEREAS, a group of citizens seeking the incorporation of a
city to be known as the “City of High Ridge, Missouri” filed a Petition for
Incorporation with the County Commission on
August 21, 2007;
and
WHEREAS,
the County Commission has received and reviewed the Petition.
NOW, THEREFORE,
be it ordered by the
County Commission of the County of Jefferson, Missouri as follows:
Section 1: The Petition for Incorporation of a city to
be known as the “City of High Ridge, Missouri” is deficient and is not in accord
with the Revised Statutes of the State of Missouri, in that:
a.
The legal
description filed with the Petition and attached to the signature pages thereof
includes a portion of the City of Byrnes Mill, Missouri, an incorporated
municipality.
b.
The legal
description filed with the Petition and attached to the signature pages thereof
includes and wholly contains the Village of Parkdale, an incorporated
municipality.
Section 2:
The Petition for Incorporation of a city to be known as the “City of High Ridge,
Missouri” is hereby denied and rejected.
Section 3: This Order shall be in full force and in
effect from and after the date of its passage and enactment.
Seconded by Commissioner
Lamping.
The members of the
Commission voted as follows:

Thereupon, the Presiding Commissioner declared the motion passed and

Hills, Missouri”
Commissioner Kemp introduced
and made the motion for the enactment of the following Order:
ORDER 09-05-2007G OF THE
COUNTY COMMISSION OF THE COUNTY OF JEFFERSON, MISSOURI REJECTING AND DENYING THE
PETITION FOR THE INCORPORATION OF THE CITY TO BE KNOWN AS “THE CITY OF SUGAR
CREEK HILLS, MISSOURI”
WHEREAS, Section 72.080 RSMo allows citizens to file a
petition with the
County Commission seeking incorporation as a municipality; and
WHEREAS, a group of citizens seeking the incorporation of a
city to be known as the “City of Sugar Creek Hills, Missouri” filed a Petition
for Incorporation with the County Commission on
August 21, 2007; and
WHEREAS,
the County Commission has received and reviewed the Petition.
NOW, THEREFORE,
be it ordered by the
County Commission of the County of Jefferson, Missouri as follows:
Section 1: The Petition for Incorporation of a city to
be known as the “City of Sugar Creek Hills, Missouri” is deficient and is not in
accord with the Revised Statutes of the State of Missouri, in that:
a. The legal
description filed with the Petition and attached to the signature pages thereof
includes a description of the boundary of the proposed “City of Sugar Creek
Hills” which is confusing, does not close and cannot be reconciled with other
language within the same description.
Section 2:
The Petition for Incorporation of a city to be known as the “City of Sugar Creek
Hills, Missouri” is hereby denied and rejected.
Section 3:
This Order shall be in full force and in effect from and after the date of its
passage and enactment.
